SIDNEY, Neb. May 25, 2006 (AP)— A judge said a 5-foot-1 man convicted of sexually assaulting a child was too small to survive in prison, and gave him 10 years of probation instead.
His crimes deserved a long sentence, District Judge Kristine Cecava said, but she worried that Richard W. Thompson, 50, would be especially imperiled by prison dangers.
When I first heard about this story, I wondered if it was because the prisons in Nebraska didn’t conform to OSHA standards or didn’t meet handicap accessibility laws. Then I wondered if he just showed up in court dressed as an elf and the judge didn’t the heart to send him to jail.
“Look at you. You are so precious with you’re little pointy shoes,” the judge seemed to say in my mind.
But no, the judge felt that Thompson would be unfairly targeted by the other inmates because of his stature. Because a guy getting basstaped (actually something that rhymes) because he molested a little girl is just and fair. A guy who is only 5-1 getting basstaped in prison for molesting a girl is just something none of us want to think about.
